PIP and MedPay for Saginaw Drivers
Short answer: PIP is the part of your own auto policy that pays your crash medical bills and 80% of lost income, no matter who was at fault. Texas policies include it unless a named insured turned it down in writing. MedPay is similar but covers medical bills only.
Check, then file
- Check your declarations page for "Personal Injury Protection" and its limit.
- Don't see it? Ask your agent for the written rejection. Under Ins. Code §1952.152, PIP stays on the policy unless rejected in writing, and once rejected it isn't offered again at renewal unless you ask in writing.
- Report the crash to your own insurer and ask to open a PIP claim.
- Send bills and proof of lost pay as they come in.
What each pays
- PIP: medical bills, plus 80% of income lost because of the injury (Texas OPIC).
- MedPay: medical bills only. It's less common in Texas.
Neither depends on fault. Your rights as a Texas policyholder are summarized in the TDI Auto Bill of Rights.
When PIP isn't there or runs out
Health insurance, or a letter of protection from a lawyer, can bridge the gap until the at-fault driver's insurer pays. See getting treatment or all insurance guides.
